Guaranteed Rights per New York State Law Article 35-D (see also: The Sale of Dogs and Cats Notice – provided by Humehill to you at time of purchase) Per NY State Law Article 35-D & 753.1 as a buyer you have a maximum of 14 days following the purchase of your puppy to have a NYS Licensed Veterinarian deem that this puppy was unfit for purchase due to illness, the presence of symptoms of a contagious or infectious disease or within 180 calendar days (6 months) from the date of purchase for a congenital malformation which adversely affects the health of this puppy. The Veterinarian must fill out a form prescribed by The Commissioner of Agriculture and Markets for the buyer to present to the seller. This form must include information which identifies the type of animal, the owner, the date and diagnosis of the animal, the treatment recommended, if any, and an estimate of the actual cost of such treatment. NYS law provides that intestinal parasites shall not be grounds for declaring a puppy or dog unfit for sale. NYS law provides that an animal may not be found unfit for sale on account of an injury sustained or an illness contracted after the buyer took possession of this puppy or dog.

Humehill’s General Health and Orthopedic Guarantee
I the buyer understand that I must take this puppy to be checked by a veterinarian of my choice, at my own (buyers) expense within 48 (forty-eight) hours from the time I take possession of this puppy to verify or dispute this puppy’s health. I, the buyer also understand that I am required to register this puppy with the American Kennel Club with-in two months of the AKC Application Transfer Date, with ownership as written on the AKC application. I the buyer also understand that failure to take this puppy to a veterinarian within forty-eight hours, failure to register this puppy with AKC within two months from the date that the AKC Reg. Application was dated or changing the AKC owner information also voids all health guarantees past NYS Law 35-D.
If I the buyer, am given a poor health diagnosis at this initial veterinarian visit due to a condition that existed prior to the purchase of this puppy and not because of any negligence or injury suffered by this puppy after I have taken possession of this puppy, I can return this puppy for a full refund of the purchase price. This puppy must be returned promptly (within 12 hours) and this puppy must be in the same condition as it was in when it was purchased, it must be accompanied by a letter from this veterinarian describing the problem encountered, along with the original paperwork (registration application, health papers, pedigree, etc.) that was given to me, (the buyer) by the seller. I also agree that upon the return of this puppy, I the buyer will sign a release form and a supplemental transfer form and will surrender all rights and responsibilities back to the seller. I the buyer understand that I am responsible (financially or otherwise) for any damage done by this puppy or done to this puppy while it is in my care. This letter must also contain a statement signed by said veterinarian, verifying that the diagnosing veterinarian scanned and documented this puppy’s microchip number. I the buyer agrees that there will not be any negative, disrespectful or degrading comments made by myself, the buyer or by another party on their behalf about Humehill or Pamela Souter, this includes but is not limited to social media. Should this happen, it is understood and agreed to, by the buyer that they will be responsible to reimburse Pamela Souter of Humehill attorney fees, lost sales income and any expense needed to amend and restore the good reputation of Humehill and/or Pamela Souter.
Orthopedic (Hip & Elbow Dysplasia) Guarantee
I the buyer am aware that a proper diet, exercise and quality living conditions are required to help this Labrador puppy grow into a healthy adult. I the buyer am aware that orthopedic abnormalities can be caused by improper diet, environment, over exertion, repetitive motion, too much or too little exercise, hereditary or usually a combination of more than one factor. As the new owner of this puppy, I understand that I share the responsibility in the prevention of orthopedic abnormalities and problems. I the buyer agree that because I will have a large impact on the future health of this puppy, I will only be refunded or receive compensation for hip or elbow dysplasia that requires surgery. I the buyer understand that I will only be compensated in the following manner and only if all the requirements listed below are adhered to.
If this Labrador puppy develops hip or elbow dysplasia prior to 12 months of age and requires corrective surgery, the seller will forward one-half of the purchase price of this puppy to the veterinarian that performed the surgery. One-half of the purchase price of this puppy will be paid to the veterinarian that performed the surgery upon proof of the completion of this surgery has been received by the seller.
Requirements of the Buyer for this Guarantee to be fulfilled by Humehill:
1) This Labrador puppy must have been taken to a veterinarian by the Buyer within forty-eight hours after the buyer acquired possession of it.
2) This Labrador puppy must have been registered with AKC in two months of the AKC Application Transfer Date, with ownership as written on the AKC application and “Humehill” must have been used as the prefix in its registered name. (Ex: Humehill George)
3) This Labrador puppy must have been spayed or neutered prior to turning nine months old if purchased with an AKC Limited Registration.
4) This Labrador puppy must not have been used for breeding (intentionally or unintentionally) NO EXCEPTIONS!!!!!
5) This Labrador puppy must still be owned by, registered to and living with the original buyer. (Original buyer per AKC Puppy Reg. Application)
6) This puppy must also have a recent (with-in two weeks of notification) negative Lyme/Tick vector test performed by a Licenses Veterinarian and buyer must provide Humehill with a statement from their veterinarian stating that this dog has not had a previous positive Lyme/Tick test, has not had an illness, injury and/or has not been prescribed medications that could adversely affect bone and joint development.
7) Copies of all veterinarian records must be provided to Humehill and microchip must be verified at each veterinarian visit.
As the seller, I agree that if this Labrador puppy develops hip or elbow dysplasia prior to 12 months of age and requires corrective surgery, I will forward one-half of the purchase price of this puppy paid to the veterinarian that performed the surgery upon proof of completion of this surgery if the requirements listed above have been met by the buyer.
Please be aware that we do not guarantee that male puppies purchased with an AKC Limited/pet registration will have descended testicles or that puppies purchased with an AKC Full Registration will be fertile or show quality. We do not guarantee for urinary tract infections, ear infections, allergies, parasites, injuries or hereditary conditions that we cannot or do not have a DNA test for.
In signing this contract, both the Buyer and the Seller agree to the terms and condition of this contract.
In signing this contract, both the Buyer and the Seller agree that this is the only guarantee that will be honored, and no other guarantees are implied by the seller.
In signing this agreement both the Seller (Humehill) and the Buyer or Agent for the Buyer (listed on the front page of this contract) have read, understand and agree to the terms of this contract.
